01 Acceptance of Terms

By accessing or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. We may update these Terms from time to time. Continued use after changes constitutes acceptance. We will notify you of material changes.

02 Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding contract.
• Your use of the Service does not violate any applicable law or regulation.
• You have not been previously banned from the Service.

We reserve the right to verify your eligibility and to suspend or terminate your account if we learn you do not meet these requirements.

03 Account Registration & Security

To use most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials confidential and not share them with others.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.
• Not create more than one account or create an account for anyone other than yourself.
• Use your real identity; impersonation of others is prohibited.

04 Prohibited Conduct & Content

You agree not to:

• Harass, bully, stalk, intimidate, or threaten other users, or engage in hateful, discriminatory, or abusive behavior.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service for any commercial purpose (e.g. advertising, spam, solicitation) unless expressly permitted.
• Solicit money, gifts, or financial information from other users, or use the Service for fraud or pyramid schemes.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use bots, scripts, or automated means to interact with the Service except as permitted.
• Collect or harvest other users' data or content without their consent.
• Upload or transmit viruses, malware, or other harmful code.

We reserve the right to remove content, warn users, suspend or permanently ban accounts that violate these rules. Serious violations may be reported to law enforcement. For a full overview of expected conduct, see our Community Guidelines.

05 Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal data. By using the Service, you agree that we may process your data in accordance with our Privacy Policy.

06 Content You Provide; License to Us

You retain ownership of content you submit to the Service (e.g. profile information, photos, messages). By submitting content, you grant us a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, store, display, reproduce, and distribute such content in connection with operating and providing the Service.

You represent and warrant that you have all rights necessary to grant the above license and that your content does not violate any third-party rights or these Terms.

We do not claim ownership of your content. We may retain copies as needed for legal, safety, or operational purposes.

07 Our Intellectual Property

The Service, including its design, features, text, graphics, logos, and software (excluding user content), is owned by or licensed to GameBadi and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our Service without our prior written consent.

08 Copyright & DMCA

We respect the intellectual property of others. If you believe that content on the Service infringes your copyright, send a written notice to gamebadiapp@gmail.com that includes:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the infringing material and where it appears on the Service.
• Your contact information (name, address, phone, email).
• A statement of good faith belief that the use is not authorized by the copyright owner.
• A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

We may remove or disable access to content we believe infringes copyright and may terminate repeat infringers.

09 Premium Features, Purchases & Refunds

Certain features may be offered as paid subscriptions or one-time purchases ("Premium" or "In-App Purchases"). Payment is processed by the platform through which you make the purchase — either the Apple App Store (for iOS devices) or Google Play (for Android devices). All purchases are subject to the payment policies of the respective platform.

Subscriptions and auto-renewal: If you purchase a subscription, it will automatically renew at the end of each billing period (e.g. monthly) at the same price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time through your App Store or Google Play account settings. Cancelling stops future charges but you retain access until the end of the current billing period.

A Restore Purchases option is available in the app settings to restore any previously purchased subscriptions or in-app purchases. We may change the price or availability of Premium features with reasonable notice. Continued use after a price change constitutes acceptance.

10 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF USERS OR CONTENT POSTED BY USERS. YOU USE THE SERVICE AT YOUR OWN RISK.

We do not guarantee any particular outcome from using the Service (e.g. matches, relationships, or connections). We are not a matchmaking or counseling service.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMEBADI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

12 Indemnification

You agree to indemnify, defend, and hold harmless GameBadi and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your content or conduct, (c) your violation of these Terms or any law, or (d) any claim that your content or conduct caused harm to a third party.

13 Termination

You may terminate your account at any time through the in-app account deletion option (see our Privacy Policy for details).

We may suspend or terminate your account or access to the Service at any time, with or without cause or notice, including for violation of these Terms, fraud, or to protect the safety of other users.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including disclaimers, limitation of liability, indemnification, and dispute resolution.

14 Dispute Resolution & Governing Law

These Terms are governed by the laws of the jurisdiction in which GameBadi operates, without regard to conflict of law principles.

Informal resolution: Before starting any formal dispute process, you agree to try to resolve the dispute informally by contacting us at gamebadiapp@gmail.com with a short description of the issue. We will try to resolve it within 60 days.

15 General

• Entire agreement: These Terms, together with our Privacy Policy, Community Guidelines, and any other policies we make available in the App or on our website, constitute the entire agreement between you and GameBadi regarding the Service.
• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
